Order Number (13/2017) for approval of litigation in accordance with the Settlement of Labour Dispute Law
(1) On 8th March 2017, Daw Kyin Aye, the authorised representative of Employer reported that the agreements which are laid down in –
Article (1), (D) Selection of skill level A, B, C is to be carried out by a group consisting employer representatives, worker representatives and experts and if needed, supervisor and all supervisors shall be allowed to participate in the selection;
Article (1), (G) Through interpreters, work related instructions of expatriates in management are to be given to supervisor, all supervisors and managers who will then instruct the workers and when Myanmar-speaking expatriates in management communicate directly, offensive manners shall be avoided in careful consideration;
Article (1), (H) the Basic Salary Column and the Sunday Wage Column of (November 2016) salary bill shall be merged into the Basic Salary Column by entering (108,000 Kyats) in it starting from (December 2016). The rest of payments shall be calculated and entered in the Production Wage/Allowance Column by the employer (supervisors are not applicable);
Article (1), (I) the monetary benefits under the Production Wage/Allowance Column shall not be deducted for any reasons by the employer; and
Article (1), (K) in relation with this dispute, the employer shall avoid imposing disciplinary measures against the workers who do not breach the enacted workplace rules and regulations
of Mutual Agreement Case Number (347/2017) signed before Hlaing Tharyar Township Conciliation Body on 15th December 2016 between the Owner of Garment Factory for Hangzhou Hundred-Tex Garment (Myanmar) Co., Ltd (Hangzhou Pi Yi), locates in Number (349), King Won Min Gyi Street, Shwe Lin Ban Industrial Zone, Hlaing Tharyar Township, Yangon Region and the workers (including U Thet Paing Oo)
cannot be complied with.
(2) Therefore, in accordance with Article (37) of the Settlement of Labour Dispute Law of 2012, U Khin Maung Cho, Staff Officer approves to litigate in Hlaing Tharyar Township Court of Yangon Region against Mr. Zhang Yonghong, the owner of Garment Factory for Hangzhou Hundred-Tex Garment (Myanmar) Co., Ltd (Hangzhou Pi Yi) who fails to comply with the mutual agreement signed before Hlaing Tharyar Township Conciliation Body with the charge of breaching Article (43) of this Law.
